Obviously because they have their issues with the SEC, there is always that possibility
But firstly, if they wanted to halt it, if they felt like investors are in immediate danger they would’ve halted it already
Secondly, nowhere in their complaint against the company do they mention wanting to shut the corporation down. Most of it points towards disciplining the CEO.
