Leo can go solo with OM if the stock price can support upwards of 40 million (dilution) for 2 trial costs. Also, any upfront payment for UP could help fund OM as well. The stock price will dictate Leo's direction with OM. If Leo can fund OM "on his own" that's a game changer.
I tend to agree with your thinking that Brilacidin OM isn't included in the current term sheet, but, the partner will be able to take a shot at it later.

Is it possible there is a separate negotiation going on for BOM and the potential partner in today’s PR can still go for it with the first right of refusal but with a better deal?
