There is not too much that they can say publicly if it is one of those scenarios. SEC would shut it down in a heartbeat

The first two would REQUIRE silence, so not to violate NDA's or regulatory authorites....

.....the others might get them slapped with a Caveat Emptor for "promotion". Regardless to the veracity, pre-pumping without completion would be described as "Promotion".
