There are a couple of problems.

Whatever that other company had done in the past will have absolutely nothing to do with COBI going forward

All that other company had done was interview them.

1. It's the people, not the company.
2. With people, past behavior is an excellent predictor.
3. They paid him to interview Nicole.

Did they disclose this payment? No.

We are in fact discussing the current/recent behavior of company officers.

It really doesn't get any more relevant than that.
