Safe Harbor Statement

Words such as "expect", "believe", and "should", are not definitive statements and are forward-looking and unsustainable by historical fact(s). See: United States Code 15 Section 78u-5
These statements are therefore hopes, intentions, expectations and possibilities and may or may not come to fruition.

Having said that; note the phrase, “…unsustainable by historical fact….” If a statement, verbal or printed, is made stating that something has happened, that statement, if false, is not protected by the Safe Harbor. E.g., “We sold x equipment to Party or Person” , or “We have partnered with XYZ” (Bear in mind that any expected future results from the partnership would be covered by Safe Harbor).

If the Party isn’t specifically named, but can be reasonably ascertained, Safe Harbor does not apply, since it relates to a claim of an already executed incident, and is therefore a historical fact which is traceable.

Any emails, tweets, etc. which state “incorrect” information, meant to deceive the receiver(s) of that information constitutes fraud. It is not a defense to state that someone else in the Company wrote the statements; nor is it an excuse that an outside Party published the information, if not immediately disputed.

I can’t believe that anyone with any intelligence (or who has a lawyer) would actually make fraudulent statements which are not covered by Safe Harbor. Especially in light of The Theranos debacle.
