Uh....NO....hell NO...LMAO....total bullshit.....
Better check the FACTS of this case...it's Comella and gang who REFUSED TO MEDIATE..not the other way around....
1) ALL Federal civil cases are ORDERED BY THE Judge to mediation
2) The U.S. Attorneys stated ahead of time and at mediation that it was "futile" as Comella and gang REFUSE TO MEDIATE....just as she REFUSES TO HEED FDA Formal Warning Letters and several rounds of FDA 483 warnings...
3) The Judge is giving Comella and gang ONE LAST CHANCE to take their lickings outside of the Court and wasting the Court's time....
4) Federal Judges are EXTREMELY BUSY and don't have the time or resources to read long and complex briefs such as Comella and gang submitted as their excuses for breaking the law.
Thus, the Judge just kicked their sorry behinds BACK TO THE MEDIATOR and said in effect, "You damn well better make a good faith effort to comply with FDA law or it's going to be different by the time I read these filings"...that is all that's going on...the Judge is buying time on the docket schedule..
AFTER Comella and gang refuse to "come to the table" and heed the LAWS OF A DULY EMPOWERED Federal agency...it's gonna be HAMMER TIME...HAMMER UM LIKE A BENT NAIL.....it's that simple.....
95% or more of cases at the Federal level are settled in Mediation...it's a well, well, well documented fact...and the Judges get pissed when one party (Comella and gang) flat out REFUSE TO MEDIATE...
Comella said from the day she responded to the FDA FORMAL WARNING LTR that she was going to "REFUSE TO COMPLY" just as she refused the FEDS offer to sign a consent decree and walk away from this disaster....
The FEDS ain't even done yet...they have the SEC INVESTIGATION on-going and it's very possible according to now numerous expert attorneys that the FDA OCI office "might" be involved (their criminal division as attorney Jaffe and others have discussed) AND the FEDS are now using the U.S. federal COMMERCE Dept and their "FALSE ADVERTISING" laws to go after these rogue clinic operators and law breakers- and have done it successfully already....
The FEDS "don't have a weak case" LOL.....OTHER WAY AROUND....thems the FACTS and they can't be twisted....
