Well If they don get suspended from trading..either it be truth or sec not doing their job for allowing financials delay since they are already delinquent in fins for more than 3 years

The SEC doesn't tell a company when OR how to file.

The SEC publishes regulations (and enforces them). It is up to the company to determine when AND how to file so that they will fall within those regulations.
