Adding to its speculation, Worlds repeatedly accuses Bungie (at 15, 22, 28-
29) of “refusing” to produce evidence and impeding the Board’s ability to prove Bungie’s relationship with Activision. This irresponsible rhetoric is simply false. Bungie never refused to provide evidence. Worlds previously attempted to engage in a burdensome and unfounded fishing expedition based on wild speculation. The Board properly denied Worlds’s motions. Because there is no merit to Worlds’s shrill accusations, it is axiomatic that there is no evidence to support them.

The Bungie reply is strong, now I need to go through the cases cited though and see how it applies here and how strong those citations actually are, how they might be applied, and how relevant.
