Everything you pointed out is true. But, if the government is choosing not to argue the constitutional violation, possibly, the hearing may not be that long.

That aspect has almost no bearing on the arguments that will take place next week. It only refers to the President's ability to fire Watt/Otting/etc. That doesn't invalidate all of the past and future actions of FHFA.

The question centers on the merits of the NWS under HERA - everything else is secondary.
