The En banc covers the NWS. It's acknowledged in the Treasury brief that the structure of the FHFA is unconstitutional... I am interested to see what FHFA says in their brief due Monday.

The 5th circuit FAQ says the goal of the court is to render opinions in 60 days. Who knows if that will occur with this case.
