I read through the patents I could find some time ago. Several were linked here. This is my understanding:
Battelle owns several patents related to Brachytherapy using radioisotopes. Vivos licensed them with the agreement to commercialize them over time. Battelles patents covered several radiation elements and described CAPTURING THE RADIATION IN A CRYSTALLINE CONSTRUCT. I think Battelle didn't commercialize themselves because production was cost prohibitive and other Brachytherapy exists using metal seeds, metal darts, etc...which were relatively cheap.
Vivos CEO, Mike Korenko, has a Doctorate in Science from the highly regarded MIT school. He developed (and patented) a process by which the Y90 was broken down to the molecular level and then suspended in the gel. This is similar to capturing a chunk of Y90 in a crystal (such as sugar, glass or salt) but his process greatly shortened the manufacturing time and significantly reduced cost while enabling the Y90 molecules to COMPLETELY suffuse throughout the tumor.
Vivos holds patents on every aspect of what was done to make this brachytherapy cheaper, easier to create, and able to saturate whatever tumor where it can be applied.
Battelle can refuse to renew a license and award some other company the license to commercialize, but they would not be able to use the Vivos methods / process and would need to start over from scratch developing their own methods / process.
It is my understanding that because of Vivos process, the Y90 is small enough to achieve 100% tumor permeation through the interstitial spacing between cells inside the tumor. This is what yields a 100% tumor kill.
Our product is desirable because Brachytherapy using seeds or darts leave the seeds/darts behind and they have been known to travel; sometimes cause trouble in the lungs / heart. Once Radiogel gels in the tumor everything is contained and held until the y90 fully decays after 10-14 days making it just another neutral molecule in the now necrotic tumor tissue. Within 3-4 months, the human body should have completely eliminated it.
