Based on the conditions set in the agreement GOIG has met them all with the exception of the audit. They did hire the auditor but how far along he or she is we do not know at this time... Also it does not actually say an audit MUST BE COMPLETED, so I would venture that an audit in progress by the 31st would qualify as all terms being met.
