The way I'm reading it is that all Bungie had was attorney argument(a lot of fast talk) with no actual evidence to prove that they were the real party of interest. The ptab is saying we are disregarding your argument and you need hard evidence. How do they submit extra evidence when discovery from both sides is denied? You can't. It's Bungie's burden to prove. If they can't, worlds just sits by and watch Bungie drown themselves.

I know I am Captain spin, but I do not see No New Evidence as a win for WDDD.
The PTAB has already ruled on the existing evidence and did not go WDDD way. Everyone says the PTAB is changing, but not to the so called NPE's.

I will wait it out, was getting back in on new evidence or PTAB decision.
So now just will wait for PTAB to rule...

I am not fan of the ruling at all.

Discovery can be a two edged sword, it can help but it can also hurt Worlds -- we just don’t know (I personally think discovery would help Worlds, but I’m not sure about this).

With recent PTAB’s ruling of no new discovery, the RPI issue boils down to this:

Same evidences but with a new burden of persuasion requirement (burden of persuasion now belongs to Bungie), and a new standard of proof (privy instead of control).

So let’s look at these same evidences and put our thinking hat on and play devil advocate: What can Bungie possibly spin to persuade the PTAB judge panel that there is NO privy relationship between Bungie and ATVI? (keep in mind that Bungie is not allowed any new evidences for its RPI spinning/persuasion)
