Material matters as a saying is not even in the same context as the color pink. The point of trademarks is to establish product identifying marketing. Biolox pink color is market identifying. There is no way to know which product you are getting if you set Biolox and Cerasurf next to each other. However theres no mistaking Kyoceras Azul. I understand why Ceramtec would sue Coorstek over color. However as you saw in the lawsuit, Ceramtec didnt have the proper protections in place and lost. Materials matter isnt product identifying expression and is owned by a different company that doesn't directly compete with Amedica or Ceramtec.
