#34594 RE: Shadow Stevens #34593

A refresher: Dimension did indeed win "one part" of the court battle. It lost all of the other counter claims with prejudice, except for the one it withdrew (dismissed voluntarily without prejudice). Dimension successfully obtained a declaration over the ownership of the PVS/SGI license.

I don't know what you have in mind by "the next part". Dimension has not appealed the dismissal of any of the other counterclaims. It has only appealed the denial of reimbursement for legal expenses. It has not reinitiated its claim for abuse of process (the claim it withdrew) and likely can't.

Tmmi has appealed the declaration.

Briefs have been exchanged. No hearing date as yet been set in the Supreme Court of Nevada. Neither side seems all that enthusiastic about pushing the appeals along.

Possible outcomes:

1. Tmmi succeeds on its appeal, and the declaration concerning the PVS/SGI license is reversed. Or Dimension does, and the Declaration stands.

2. Dimension succeeds on its cross appeal, and the Supreme Court order reimbursement of legal fees. Or Tmmi succeeds, and the cost award made by the district court stands.
