Excellent points Lucky (777), we would all be better off if they take it to market and nab that 26M in "Free Cash Flow to the Investors" as was said and that is where I originally got my price point of $1-$3 based on 70M OS at that time.(was basing 70M OS from original private placements in addition to current OS) Less shares would mean larger Price Point. Larger Price Point means less shares needed to add in order to raise additional capitol. As I have mentioned before, where we will see the highest possible gain in SP would be taking it to Market and getting that 26M paid out in dividends to the common stock. It's amazing how just a few cents can blow up the SP of a stock IMO. Humorously, people will not invest in a 1% APR CD from a bank but will go all in for a stock that pays 1% dividend.

Yes the license agreement does tie their hands on options as you mentioned, so in order to sell HS license agreement, they would have to sell the company "Lock, stock, & barrel" as it is Lexington as a company, that holds the license agreement. (however they can license out any improvements to the original device whereas Lexington was issued patents of such to companies wanting to use that technology in their own devices while still maintaining use of the tech in HS (IMO)) In the original license agreement with Berkeley, there is the milestone payments as you said, to be paid to Berkeley which shows that original intentions/requirements are to take this product to market so if they did want to sell, the new company would have to keep the company "Lexington" in tact as well as abide by the stipulations of the license agreement. As far as the buyers, I agree with you entirely as I am sure many of us do, that we are lacking in that area. However I would be willing to bet that there is plenty watching for FDA clearance and then will try to get in on the rise.
With this being said I think that there will many of us selling some at that time and a few I'm sure that will sell completely for the gains. So access to shares shouldn't be a problem and less OS IMO will make for sharper climb and higher SP. Supply & demand simple rule.
