What is there to prove? Look at every filing and PR mentioning CVSI-007, they all say "patent pending smokeless tobacco technology." They never claimed to have a patent, they never hyped anything.

CV Sciences never hypes anything ever. Years ago, that was a common complaint from impatient people around here. They wanted "news".. They wanted CVSI to talk big talk and pump their price... But they never did, because they are a real company and knew that the value of the company would be a direct result of their hard work, sales, education, marketing, etc.

They don't need to address it.
Every article you see concerning the "class action suit" is requesting people to contact them to be a lead plaintiff...because they have none. Anyone who bought stocks prior to last week has made money, only the shorters have been screwed.
If you do your DD, and read the sec filings, you can see that what they are alleging never occurred.

I also agree that company doesn't have to issue any statement. They were always clear that patent is pending and this is correct statement..
If there was anything wrong on their side then yes, they probably should say how they are going to correct it moving forward .
Yes, they are going to list lawsuit in Q3 filing and that lawsuit is without any merit. That's all that they need to do.
