I looked again (three times now). I believe you may be confusing the "No prior short selling" section with the "Limitation on Short Sales and Hedging Transactions" language.

The former, which applies to short selling PRIOR TO the agreements, is in both. The latter, which appears to short sales SUBSEQUENT TO the agreement, only appears in the $30M agreement.

I linked both previously...if I'm wrong please provide the page number in the recent agreement in which the Limitation language appears.
