isn’t it up to the broker dealers to seek damages/compensation for any losses they incur?

They didn't know it was the DTC's fault until recently. All brokers were sent repeated letters and memos stating the DTC could cover all shares. No one ever asked the DTC for proof.

So as far as the brokers knew, it was their issue.

There is a huge paper trail of lies from James Femia that basically misled everyone from the brokers, the SEC, and FINRA.
