I have no problem with your assuming that they applied but that's not what you said:
"They did announce the BTD application."

For the second and last time, they did not.
If they had, and they had been truthful when they made such an announcement, then at the very least we would KNOW (no assumption required) the last possible date that they could have submitted the request.

You're free to assume what you will, obviously, up to and including that they must have filed by 8/1 or they wouldn't have been able to secure the designation within 60 days. Or they must have filed by the time they signed the agreement on 6/28 that included it as a milestone. My only point is that it is unfortunate that the company has put you and everyone else in a position to HAVE TO make assumptions. They could have obviated the need to do that by making the announcement that you have said that they made but didn't.
