I dont think anyone was arguing the patents last i checked. Everyone, agreed that the patents where part of GB and the moon shot. Because if they dont get them. Then, they dont have really anything that sets them aside from a regular pot grow.

As far as the patents according to the USPTO office can take up to 5 years for approval.
