So what exactly is a qualified bid.

2. Does the liquidation plan includes both tangible and intangible assets or is it only the physical assets that are being liquidated?
At this stage, we have included the intangible asset as a separate lot. In the end, we will select the bid combination which maximise cash value. Therefore, if a liquidator decides to bid more for the assets and is only interested in the physical components, then only the physical assets will be liquidated and the intangibles will be discarded.

We believe the intangibles of the company cannot operate independently from the physical facility (Mainly trademark, patents, trade secrets).


3. Also in the previous email you mentioned that solicited parties were asked to bid on different lot so does that mean the company is being broken down in to different lots and sold to maximize the value of the assets?
We are open to all combinations. Bidders have the choice to bid on different lots, but if a strategic is still interested in paying more for the overall company, then we will choose that one.

It started last Wednesday and there is no auction planned at this point. We will proceed in a similar way that we did for the first solicitation process. We are asking solicited parties to bid on different lot before Aug 21st and will analyse all offers received at the end of the process.

2. Will there be any update on PwC website if you have started to receive bids for purchase ?
No update on specific bids will be updated on the Monitor's report as the process is confidential. Website will be updated at the end of the process.

3. Do they need to wait until Aug 21 to announce Buyer if they have any or can they announce as soon as some deal is finalized ?
We'll report on the conclusion of the process in our Court report around Aug 28.
