They are not even in the liquidation period the court has to establish that and the new release says they will now consider other offers.

One of the three primary holders is going to buy and the DIP financing will be funded.

Nope. The company makes all the decisions. The court can't interfere with the business activities. If the company falls into law case, like Filing Bankruptcy, the court will then monitor it.
