Judge Schiltz did not give a definite indication of his leanings. In fact, he considered all of his responses during the hearing to be first reactions subject to "further thinking."

Judge Schiltz says:

I'm wondering whether there is -- here's my first reaction to this, and it really -- like everything I'm saying today, it's just a first reaction subject to further thinking (page 113).

First reactions of a judge are not useful material for forming an opinion of leanings.

Judge Schlitz was exploring the counts in the case with the attorneys on both sides and such explorations are also not really good indications of leanings since he can and did take a side, here and there, for arguments' sake. He also stated that much research was needed and this indicates he is not settled in his case understanding or determinations. More than six months have passed since the hearing and still no order issued on the motions submitted.
