The ultimate decision will be by the administrative law judge, which was set by the SEC. BTW, the supreme court just ruled this morning that this set-up (aka setting their own trial judge) is unconstitutional. As stated earlier, I do not believe this will have a bearing on the GDSI case. I believe GDSI will win on the merits of the case.
