I don't think Otto intended to be a scammer or may not intentionally be one at this point.
Otto, like SRSR, its shareholders & stakeholders, are all casualties of Byrnes' wars with the NYS DOL, Kathleen Fiero, and his trading accounts.
Otto, along with his family & friends invested in SRSR. A significant amount of money: $750k more or less, at an average price around 2 cents per share.
Otto was ecstatic when the stock jumped , he even took Keevil on a helicopter ride over the Danube in 2009.
Everything was peachy 'til the SRSR stock price slumped after the Chinese SOE didn't complete the deal, and the metals market disappeared overnight.
Pichler became frustrated, and took those frustrations out bitching to Keevil.
But Pichler remained a true believer in the Nemegosenda Niobium project.
At about the same time, Dan came on the SRSR BOD as he was being pursued by the New York Department of Labour for placing 96% of the Ft. Orange pension plan assets into Sarissa stock. A big NO NO. Thus, Pension Fund Trustee Dan had done an illegal act.
Trustee Dan panicked.
Instead of owning up to it and asking Scott, Pichler to help him out he did what Dan always does he blames someone else for his own misfortune.Like the whiner he is he frantically told the DOL that Scott, Currrh had screwed him and its was their fault, not his.
NY DOL didn't buy Dan's BS and eventually sanctioned him for $310,000 for his ill advised action.
Earlier that year Dan's sister had taken him to court for putting $250,000 of her money into SRSR without her consent. Apparently, Dan was also the Trustee of an inheritance, directed her money for his won gain. This set back further drove Desperate Dan to blang others for his blatant, numbskull misdeeds.
The court awarded Kathleen Fiero $254,000 court judgement against Dan.
Now Dan began to make up stories about how Evil Keevil and Currah had 'stolen' from the company and money was missing. Of course Diector Dan signed off on a 2013 Nio Star audit and a 2015 SRSR 1st quarter financials after reviewing the books (he has NOT to this day retracted either of those signatures)so he didn't talk about 'stealing' at the time.
Dan's purpose now he had two court's heat on him wash to brainwash Otto against Keevil so that he could try to transfer the Nemegosenda property to IGEX, load himself up with free stock and horribly dilute the SRSR shareholders and completely screw SRSR/Nio Star creditors.
SRSR creditors stopped this illegal transfer easily complaining to FINRA, the SEC, the OSC and the IGEX auditor.
The scam deal never happened.
Finally Dan the Dunce told Otto Pichler that the Lithium deal was no good as SRSR's interest would be greatly diluted out. Dan was too inexperience, too ignorant to understand what a 25% CARRIED INTEREST meant. So Otto tore off Tor Boswick's head off(on of the Lithium Group's representatives) over the phone screaming at the man that he "would burn his shares" before doing the deal.
After Dan asked Otto on the board Otto began to realise what an idiot Dan had been and was. They fought bitterly and eventually Otto had Dan the Dunce removed.
The only winners here are the many bulls-eyes in Byrne's elaborate blame game.
Hopefully, Otto Pichler as Operation manager of the SE winkie drill program which was a disaster-three holes instead of 40, none completed to depth, no results that we know of, $40k of billing still not paid-he has leaned that he cannot run a exploration firm.
Dan had led Otto and SRSR shareholders to the ruins which SRSR is in now.
When Keevil was still there the stock was 7 times higher, there was a website, there were no multi million dollars lawsuits, no IGEX hijinks, taxes were paid up, controlled a great gold property which D'Otto sold for nothing, vetoed a great offer to develop the property, no Nevada registration, a secretive BOD (No PR's), no financial disclosure for over three years.
These above calamities ALL occurred under Dan and Otto watch and for anyone to blame anyone else for their misadventures is poor and utter nonsense.
Is Otto a scammer?
If he tries to give the 51% of property away to Pottsy for $250k he certainly is attempting a scammer technique.
Fortunately he won't be able to do it as the Nemegosenda property is the only asset that SRSR owns so shareholders vote for approval is necessary as well as the creditor's consent.
This issue will be cleared up in Ontario by the court and the OSC if Otto persists.
