That may all be true. But the crucial question is, does that have any relevance to the judge in a BK proceeding?

If on paper he is a creditor, and the requirements are fulfilled, I don't think the ruling will be based on a lookback of past performance.

It is a tragedy and a travesty, but that's how it is.
