Tane, the law specifically states that the petitioners "must do more than establish that the debtor is not meeting its debts as they mature", so the fact that the company owes Marshall money is not the only determining factor in this type of proceeding, and

(2) the company seemed to be pursuing a remedy to pay of its debts.

Sounds to me like the company has a case....
