I wouldn't discount that information. If the mine was actually operating, how come they did no more actual mining? Only one blast to my knowledge. It appears that their activities were limited to tinkering with the leach system and produced nothing more than 8.2 ounces (or was it 8.5 ounces?), and some gold in carbon?

And it does appear that there are environmental violations. The water well issued proved to be true as well.

This will take some sorting out, but it appears that Garci51 was credible on some important issues.

So, we all can agree the mine hasn't been shut down, and we can all agree no criminal charges been levied.

No, not going to agree to that. A shutdown can take more than one form. They might be prohibited from "mining" (i.e. blasting, hauling, crushing, etc.), or they might be prohibited from even occupying the site. Or maybe there is no shutdown at all.....that's the beauty of promoting a mine in a far away place, it is hard to check out these things.

As for criminal charges, again, who knows?
