Yes and all I am saying is his confidence in his own argument is not the complete basis for his comments in regards to winning this case.
He has been before CAFC judges before his understanding and experience of how these judges think and make decisions also comes in to play in my opinion.
I agree he is not going to say “ I don’t think we are gonna win this one Mr Kidrin. But I do believe his experience speaks to a better understanding of how the case may go, beyond just his confidence in his arguments only as you state.
