No one stated Nextcode nor OP3 had an implied license.
It was simply stated there are two types of licenses; direct license of the IP and license of qode which contains an implied license to the IP

NEOM did NOT State they aren't in search = in fact Chas Fritz (CF) clearly stated that one of the 5 patent "sets" or categories if you will, his term, IS mobile search - note it was set 2 - which CF stated includes ads off location based search; incidently also including comparison shopping and contextural ecommerce. (These are from the acquired patents from BarPoint/LoyaltPoint.)
