abcd's post a few hours ago showed eight jurists who had one or no appearances this week.
Chen and several others had two, and if you add in the en banc full court session today, Chen (and others) would have three panels already, so I'm leaning toward those who don't have that many. Unfortunately, there have been several occasions over the past three months when a judge has sat in on four panels in a week, so the 3-and-out rule doesn't hold strongly.

We're gambling here. In my mind's eye, I see both Dyk and Newman on our panel. That third person will be the key. Taranto or Stoll and I'd say we're golden. O'Malley or Schall and I'm not so sure.

But I do like your Chen and Taranto pairing. If I see those two names in Room 402 tomorrow, I'm sending a box of Havana longs down your way !!!
