It's the same case, different court room with Adkins Energy. Except, the other appeal, filed by Adkins, is based on a contract dispute in which GERS won. The motion for reconsideration is based on the same motion filed with Judge Miller.
Yes, the consequence would be that GERS' wins the case at a lower judge by reversing McKinney's original ruling (with Adkins).
She'll probably rule in lockstep with Miller. The appeal will move forward regardless. It would surely shake things up. Maybe I'm reading into it, or maybe there's good reason she's taking her time? I would be happy either way.
