Right off the bat, when I read at the beginning of the brief this sentence (alluding to the PTAB making decisions as a judicial body, not an administrative one):
"This is the exercise of the Judicial power—but without
the Article III safeguards of life tenure and salary protection"
Wow- hit 'em where it hurts. No stacked/ politicized/ former Big Corporate employee should be sitting in a "judge's chair" when a tenured judge is available.
I like the argument. Hope it holds up.
