Brauser was not listed as a 5% owner of common shares. It shows with warrants he could have been although it looked like he was selling out fairly quickly considering how much he reduced his position in a few weeks. We also know no warrants had been exercised so how could he own more than 5% of common?
His common shares position was clearly shown to be under 5% in the filings.
