The VOP portion only depends upon the judge. The latest DUI charge would be put to a jury if CONvictEd is stoopid enuff to take it to trial. The VOP count is based in part on the idiot-CEO driving AGAIN with a SUSPENDED LICENSE when he was picked up for the latest DUI/drugs charge.
CONvictED can't CONtest the VOP for the driving with a suspended license part, as he clearly had a suspended license from his prior DUIs and arrests.
Regardless of a jury trial, CONvictED is going BACK to jail and by the beginning of next month at the latest. So the MYEC HQ will be moving behind bars with the criminal CEO.
