I believe you can insert info as "subsequent events" in a 10-K, so being 4 months ago is not necessarily a limitation. However, I still do not buy the explanation that the 10-K is being delayed just so that PM revenue can be reported.

I believe that the missing 10-K is so that noteholders cannot convert. And it saves them the cost of preparing the 10-K.
