"Do DD" - I can't understand why you state there will be a trial when the judge stated "Judge Spencer noted that he felt "most if not all" of Tercica's case "could go out on summary judgment."
The judge feels that he can make a determination which would make a trial unnecessary. It looks like he's going to slap INSM on the wrist at the most and tell TRCA that their case is not worth the courts time.
