Correct. The filing clearly shows they were authorized to issue up to 300 mill shares before dec 2008 and up to Dec since it says nothing about they can't issue any shares before Dec 2008 (if it does not say they can't then they can). It does NOT say that they were never allowed to issue any equity prior to that date.
Like I said case closed. Luckily the readers (if there are any left after this drawn out diatribe LOL) will be able to decipher it.
And other filings as I've stated clearly show they were able to issue equity and did ($9 million to Alpha and Longview).
Funny thing is,Arland isn't even a 5% owner and hasn't been for many years plus Alpha seems to be moving on with them selling down their position over time.
