40 mil volume is insane for a company with only 11 mil outstanding. I have no reason to doubt that the patent news took them by surprise. It was not VTGN that put out press release. Somebody picked it up and put it on seekingalpha.
The Company needs 20 plus million, I would be surprised if they were not exploring all options for financing.
