#44249 RE: GTCar #44248

Keeping on that notion of one year, is there a scenario where Apple, AT&T, Verizon or Twitter can file anymore IPR's?
------

Apple, AT&T and Verizon cannot file any more IPRs. Anyone else can due to the terrible rule regarding standing - one does not have to have standing to bring an IPR. This rule should be addressed by SCOTUS in June IMO.

Twitter can bring an IPR but my opinion is that they will not since Twitter would better be suited to preserving any invalidity challenges they might have for their defense in the civil infringement suit. Furthermore, if Twitter were to initiate an IPR the risk would be much greater than if it had initiated one alongside Apple, Verizon and Unified Patents as it would be precluded from raising similar claims to those that were raised by Apple, Verizon and Unified Patents. Additionally, I would think that any IPR petition would be denied if Twitter should have or could have joined as a party in the earlier IPR petitions.

Just my opinion, ofcourse.
