I think it is the lack of follow up that is concerning.

When the company filed suit, it demonstrated activity. When they have failed to meet any deadlines or submit any requirements per the courts order - this has to be of concern as it demonstrates inactivity.

Today's required filing wasn't about the three defendants they didn't manage to serve - those three were already dismissed weeks ago.

Today's filing is required in order to continue pursuing all of the remaining defendants.

As of 6:20 Eastern, the company hasn't bothered to file anything.
