I think it's the responsibility of the poster to be clear about the subject of their post. Not that hard.
At the risk of sounding like an Admin shill, I don't think they should have to do research to decide if a post is OT or not.
As a mod, I have to make similar decisions about TOS, and it's can be a confusing time waster.
