There are likely a number of factors that likely need to be considered. Expressing an opinion about a stock is not illegal. So while a vast majority of SEC actions are for illegal stock promotion...and as far as I am aware there have been none for illegal stock "anti" promotion of penny stocks for sure. The only situation I can think of where this might be an issue is with exchange traded stocks that can be shorted relatively easily. ACTUAL shorting of penny stocks is exceedingly rare.

However, in most cases, manipulation schemes in the OTC involve insiders or undisclosed insiders...or people associated with them.

The expansion of the SEC's enforcement approach would seem to be consistent with the types of action they have taken in the past.

Absolutely. The elaborate negative speculation coming from these hilarious, anonymous, avatar stock gurus is laughable. They posture as experts, regularly slander reputable folks and for some reason constantly attempt to malign the character of the CEO. If I was him, I would use all tools at my disposal to defend myself from these internet con artists.
