That question is irrelevant. The entire purpose of the app is to promote safe driving. Simply "shutting a phone off" doesn't really work otherwise there wouldn't be so many car accidents involving texting and driving, would there?

And on another point; the company definitely would not pursue on the development of an illegal product/ product unable to sell and generate revenue; so that claim makes no sense.
