I am merely pointing out the issue of Reg FD when someone suggests he is confirming the deal. But Reg FD can cover lot of ground. Even if a statement he makes via email can be inferred to be confirming the deal he could be liable.
That is the problem with what he may/may not be doing with specific email communications or texts.
By even discussing the "deal" and what may or may not happen...he is opening himself to such liability.
So either his emails are fake....in which case anything coming via that mechanism is suspect...or he is really emailing about these things and he frankly should not.
