Honestly I'd rather it was "failure" and not a "Scam".

If it is a scam, people go to jail, or, more likely, be barred from being an officer or or a director of a publicly traded company for life.

Sadly, if it is a failure, they will likely do the same thing again (one more try!) and more people will lose money.
