If Wifi one gets decided before CAFC decision? Okay, now Oral arguments were May 5th on WIfi One, CAFC decision usually reached within 6 months putting the decision on that due in by Nov 5th. WDDD WILL NOT EVEN HAVE HAD ORAL ARGUMENTS BEFORE NOV 5TH. So it will be pretty difficult to get a CAFC decision on WDDD before Wifi One.
CAFC decision will take about 6 months. Being as this will not be on calendar before the first week of Dec, that puts decision in about June. BY all accounts and many sources, the Oil STates SCOTUS case will be decided June or before as the overwhelming majority of case get decided by SCOTUS before they take the break in June. So the below statement will be incorrect. Like saying BUngie will cross appeal (which was also incorrect and stated by Alpha) if you follow the timelines, this statement will also be proven incorrect.

A safe assumption is that there are people who are waiting on the judge panel before increasing, decreasing, or starting a position.
If a selection of Judges as mentioned in above quote happens it is suggested that it will be a negative catalyst for PPS of WDDD, it then logically follows a Judge panel with 2 or 3 patent friendly or pro patent judges would have a positive effect on PPS. A patent friendly Judge Panel would also likely increase the chances of regaining some claims lost in PTAB. So a bad panel "ït will hurt" and a good panel would be ä minor positive"? However there are people that are waiting on the judge selection before starting a position. I would suggest that a pro patent judge panel would be a major catalyst. As stated in the quote above, risk goes up- bad...again logically follows risk goes down---good.
