JCNJ, this is not correct.
The DOCUMENT have not been sealed. You can follow the complete case on PACER including all testimonies from PPHM and CSM people.
The SETTLEMENT terms have been sealed, on demand of CSM. Yes, PPHM did NOT have to accept, but 600K was the maximum they could get under the 'mistake' of JB. Not accepting could actually lead to more legal fees, longer dragging all this further (with at that time Sunrise being the focus), ...
What is, IMO, the REAL reason this is sealed is that there is some prove it was sabotage and that CSM was not pulling this for the first time. PPHM had tried to get fraud on the ticket but the Judge said it was to late. However, you can only plead intend if you have something to make it hard and PPHM might have gotten that to late.
Jeff suggested intend in his VERY FIRST report already the week it all happened. However he suggested it in a circumstantial way saying it was IMPOSSIBLE this happened BY MISTAKE.
But as Chris Keenan ones said in a more private setting: One needs to know what the woman was thinking before you can speak of intentional (not his exact words but the idea is there).
And hence PPHM might have sought for the hard evidence, found the hidden/secret logs and very possible must have been developing a theory for the DOUBLE dose switching because ONLY ONE was explained by JB in her testimony and she always claimed that the second one were errors from the work floor. She, JB, can say it but PPHM needs to PROVE that it isn't true and how do you do that when it happened at a 3rd Party CRO (CSM in Fargo, ND) and you get the info that they want you to see.
And THAT will be the bases of the sealing of the settlement. How different wouldn't it have been if PPHM would have found the PREVIOUS case (the sealed records by CSM in another case and other State). But it came up to late because of the Summary Judgement. Possibly that info is in the sealed documents and was the basis on which PPHM wanted to make it's case.
