Worlds is trying to kill the Decision "in the crib". Primary attack line is bottom lined.
Worlds presented a publicly available legal document that showed Activision's control over legal matters related to the Destiny Games. The PTAB Board said we dont see that as enough for additional discovery.
In the "psuedo-court environment" of the PTAB "quick kill" is the order of the day, regardless of the dollars on the line. In any other normal JUDICIAL Courtroom a Judge would allow Discovery with a lot less requirement needed. I think the COA may set aside all other decisions and reverse based solely on that. IMO a very good chance.
In light of SCOTUS and Oil States, kicking it back for this reason alone makes a lot of sense. Worlds gives CAFC an easy way out and sends the PTAB a message that if your going to "play Court" you better do it right.
